　　We have received your bureau’s “Request for Instructions on Whether Enterprises Need to Obtain a Food Additive Production License for Nitrogen Produced In-House by Nitrogen Generators Used for Nitrogen-Flushing Protection in Food Packaging” (Suzhou Food and Drug Administration [2014] No. 88). After careful review, we hereby reply as follows regarding the relevant matters:

　　The Food Safety Law of the People’s Republic of China stipulates that the State shall implement a licensing system for the production of food additives. The National Food Safety Standard—Food Additive Nitrogen (GB 29202–2012) sets forth the technical requirements that must be met by food additive nitrogen produced using small, dedicated nitrogen-generation equipment. Accordingly, enterprises may only produce and use food additive nitrogen after obtaining a production license in accordance with the law.
